The Future of Software Taxation: Australia and Beyond

A panel discussion with Chris Ferguson, Megan Funkhouser, Miranda Stewart, and Benjamin Lancaster

This panel discussion will consider the issues associated with characterising payments made in respect of software, including:

  • Setting the scene – policy considerations and a global perspective on taxing intangibles and other royalties.
  • Is the ATO view in TR 2021/D4 out of step with global consensus or will more countries adopt the ATO’s approach?
  • The ATO’s perspective, the feedback received from consultation with industry and other revenue authorities.
  • What’s next? More consultation and another draft – what should we expect to see?

Speaker: Chris Ferguson

Chris Ferguson is a an Assistant Commissioner in the Public Groups & International business line with responsibility for strategic case leadership. Chris also has responsibility for risks relating to arrangements involving the migration of intangible assets and for the delivery of the New Investment Engagement Service.

Speaker: Megan Funkhouser

Megan Funkhouser serves as Director of Policy, Tax and Trade at the Information Technology Industry Council (ITI), representing the world’s most innovative companies. She focuses on advancing ITI member priorities in the international tax space.

Speaker: Miranda Stewart

Miranda Stewart is a Professor at the University of Melbourne Law School and is an Honorary Professor and Fellow at the Tax and Transfer Policy Institute at the Crawford School of Public Policy, the Australian National University. Miranda is also Vice-Chair of the Permanent Scientific Committee of the IFA.

Chair: Benjamin Lancaster

Benjamin Lancaster is an Of Counsel in Jones Day’s Australian tax team. Benjamin practices in the area of tax dispute resolution, with a particular focus on transfer pricing and other international tax issues affecting the energy, resources, and technology sectors.
