This report, on one of the two main subjects for the IFA 2022 Congress in Berlin, considers the taxation of data transactions in Australia. Commencing from the starting position that Australia does not recognise property rights in data per se, this report explores the income tax consequences of a data transaction.

A data transaction may be characterised as a royalty, a service, a sale (on income account) or a capital transaction. This characterisation, along with traditional concepts of residence and source, will largely inform the domestic income tax consequences of a data transaction. This report considers the interaction between Australia’s domestic income tax principles and the rules contained in Australia’s tax treaty network, with a particular focus on permanent establishment thresholds, transfer pricing principles and royalty withholding taxes.

Presenter: Thomas Ickeringill

Thomas Ickeringill is the representative of the Young IFA Network for the Australian branch of IFA. He is the Australian Branch Reporter on the subject of ‘Big Data and Tax’ to the 2022 IFA Congress in Berlin. He is a Senior Associate in the Tax Practice at Allens.

Moderator: Paul Sokolowski

Paul Sokolowski is a Partner at Arnold Bloch Leibler and the leader of the firm’s taxation practice. He acts for a diverse range of Australian and international clients, including high net worth individuals, some of Australia’s largest private groups and public companies. Paul is the Secretary and Deputy President of the IFA Australian Branch and is a member of the Branch’s Executive Committee.
