Most corporate taxation systems began life under a separate entity approach. Over time elements of a group approach have been layered on top. However, certain of the BEPS developments have further expanded the scope for groups to be treated differently in the context of cross border transactions. Pillars 1 and 2 go even further in some cases for larger groups by disconnecting the group treatment from the underlying transaction.

Australia’s income tax law in general treats a company as a separate taxpayer distinct from its shareholders.  In response to the rise of corporate groups, the income tax law has introduced various regimes reflecting the application of the enterprise doctrine, under which a corporate group is treated – to different extents – as a single taxpayer. This reflects the economic reality that a corporate group often operates as a single enterprise from an economic perspective.

Speakers:

Presenter: Peter Stinson

Peter Stinson is an Associate Partner, Ernst & Young, Sydney. He is the Australian Branch Co-Reporter (with Assoc Prof Antony Ting) on the subject of ‘Group approach and separate entity approach in domestic and international tax law’ to the 2022 IFA Congress in Berlin.

Peter’s working life has been spent at large law and accounting firms predominantly advising in the areas of corporate taxation including tax consolidation, cross-border tax issues, and the taxation of trusts and partnerships.

Peter has lectured in taxation subjects at tertiary institutions and has written and presented papers at professional associations’ conferences and seminars. Peter is currently completing his PhD at the Business School, University of Sydney, in the area of trusts and partnerships in tax consolidation.

Moderator: Paul Sokolowski

Paul Sokolowski is a Partner at Arnold Bloch Leibler and the leader of the firm’s taxation practice. He acts for a diverse range of Australian and international clients, including high net worth individuals, some of Australia’s largest private groups and public companies. Paul is the Secretary and Deputy President of the IFA Australian Branch and is a member of the Branch’s Executive Committee.
