About the Panel Discussion

The IFA is pleased to host a panel discussion on the Full Federal Court’s decision in Hicks and its implications for both domestic and international group restructures. Handed down just before Christmas, Hicks has largely flown under the radar, yet represents a significant loss for the ATO. The decision raises important considerations for go-forward tax planning, structuring and advice, particularly in the context of intra-group transactions and restructures.
Chaired by Shaun Cartoon, the panel will explore the reasoning in Hicks, practical takeaways for advisers and taxpayers, and how the decision may influence future ATO approaches and litigation risk both in domestic and international settings.

The Hicks Decision

Chair: Shaun Cartoon (Arnold Bloch Leibler)

Shaun Cartoon advises a range of clients, including ASX listed companies, high-net-worth individuals and large private groups. Shaun practices in corporate, international and employment taxes, with particular expertise in mergers and acquisitions, corporate restructures and employee share schemes. He also assists clients to navigate complex tax disputes with the Australian Taxation Office and has litigated significant cases through the Australian courts.

Bradley Jones SC (Senior Counsel for the taxpayer in Hicks)

Bradley Jones SC is a Senior Counsel at Ground Floor Wentworth Chambers, practising in taxation, administrative and commercial law, equity, family law and military law. He has particular expertise in Commonwealth and state revenue matters and regularly appears for both taxpayers and revenue authorities in the Federal Court, Administrative Appeals Tribunal and the High Court of Australia. Bradley has advised clients across industries including banking, finance, property development, pharmaceuticals, telecommunications and mining, and has also advised the New South Wales, Western Australian and Queensland Governments on Commonwealth tax matters. He regularly appears in complex family law property disputes involving taxation and equity issues and is a Chartered Tax Adviser, a Fellow of the Society of Trust and Estate Practitioners, and co-author of Evans, Jones & Power, Equity & Trusts.

Ermelinda Kovacs (Tax Bar)Ā 

ErmelindaĀ Kovacs is a barrister at Ground Floor Wentworth Chambers specialising in tax law. She has over 20 years’ experience in tax, having previously practised as a solicitor and held the position of Director in Ernst & Young’s Tax Controversy practice. Ermelinda is frequently retained by the Commissioner of Taxation, the Chief Commissioner of State Revenue and a range of corporate and private clients in Federal and State tax matters, including complex Part IVA cases, CGT, international tax, GST, consolidation, payroll tax, transfer duty and land tax. She is recognised in Doyle’s Guide as a leading tax junior.
